我去年搬家费被拒理由- You did not move from one location to another within Canada
- Note the in order to deduct quanlifying expenses for a move to or from Canada, you have to be considered a deemed or factual resident of Canada while living outside of the country or a full-time student in receipt of taxable award income.

CRA有说被拒的理由吗?
网站上看到T1M表格的解释 “You cannot claim moving expenses if you rent an apartment in
another country where you are working temporarily and you
maintain residential ties in Canada (for example,your spouse and
children remain in your home in Canada) because your home in
Canada is where we consider you to ordinarily reside” 我家确实是老公在美国租了一个apartment 我跟孩子在加拿大还住在原来租的apartment里。

刚才给CRA打电话,说可以申报搬家费的。temporarily的意思是如果你被派去美国工作短暂的时间,比如三个月,之后又回到加拿大工作之类的。

又糊涂了,CRA说我老公不能用401K减税,因为他不是commuting(每天回家或每周回家的)。报了搬家费,就不能用RSP额度减税了吗???这不是抢钱吗,除了交税,所有减税项目都享受不到,去美国干啥啊。。。。不如在家吃福利:(

401K的钱是在你的W2工资数字之外的,你再当RRSP减掉一次就多减了一次

我倒觉得CRA的人也稀里糊涂的。又看了一遍网站上的说明。这种只身一人去美国工作又要在加拿大报税的,算是factual resident 定义为“working temporarily outside Canada"
在T1M搬家费的解释里面,从美国搬到加拿大的搬家费不能报税,(因为家人的住址还在加拿大),但是在美国不同城市之间搬家费可以报;
Factual resident可以用RC268表格把401K的收入换算为RSP抵税,
summary:不能报加拿大搬去美国的搬家费,但是可以报401K。CRA电话里正好给我说反了。

可是我报收入的时候,按照CRA的要求已经把401K加进去算income了。网上上说factual resident 可以claim 401K算RSP再减掉的。电话里又告诉我不能。说我老公不是temporarily work in US. 那我老公到底是factural resident 还是non-resident呀。

From CRA website: "If the amount on your United States W-2 slip has been reduced by contributions to a "401(k),457 or 403(b) plan, US Medicare and Federal Insurance Contributions Act (FICA)." you must add these contributions to your foreign employment income on line 104 on your Canadian return."
